Is Memrise in breach of contract for paid accounts?

For those of us who have paid subscriptions or for lifetime accounts, I’ve been trying to ascertain if Memrise is in breach of contract.

This post says that Memrise hosts 300,000 courses:

The number of Memrise created courses is currently at 1238. This means 99.99% of courses will be moved to Decks and therefore affected by the upcoming changes.

For my own created course, this means:

  • No more Learning Stats
  • No more Offline mode
  • No more App

These features will become free (great if you haven’t already paid for these) :

  • Difficult Words
  • Speed Review
  • Listening Skills

On Memrise’s Terms of Use page, point 14, it says:

We may suspend or withdraw or restrict the availability of all or any part of our Services for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal, but this may not be possible.

The law supercedes any contract and I’m currently looking into this aspect. Some of the changes are a benefit for free users, but for those who have paid for the benefits of a pro service, that benefit will be rendered redundant. For the record I have requested a partial refund on my subscription.

I’m interested to know what the rest of the pro community thinks about this aspect, or any information that could enlighten us.
